Unapproved Minutes of the June 12, 2015 Meeting of the Iowa Civil Rights Commission
I. Roll Call: Williams, Hosford, Oelschlaeger (byphone), Cunningham, Lipski, Hou, Staff: Director Johnson, Merrill, L. Johnson, K. Smith
AG: Fiala, Buller
II. Motion by Lipski to approve participation of Commissioner Oelschlaeger by phone. Seconded by
Commissioner Cunningham. Motion passed unanimously.
III. Noted for the record that Commissioner Conley has recused himself from considering the matters before the Commission at this special session and took no part in the hearing or deliberations. See order marked as C1.
II. Public hearing on ICRC v. On Point Security Group, LLC and Howard Johnston, DIA No. 14ICRC001, CP# 08-12-62947. Arguments were heard from the ICRC, represented by Ben Humphrey and Respondent On-Point Security and Howard Johnston, represented by Tom Graves. Commissioners present asked questions and participated in active discussion around issue presented on appeal, i.e. whether the decision rendered by the ALJ should be affirmed, amended or rejected. The ICRC asked the Commission to reverse the ALJ. Respondents asked the Commission to affirm the decision. For issues presented to the Commission, see briefs filed by parties.
III. At approximately 10:30 am, a motion was made by Commissioner Lipski and seconded by Commissioner Cunningham to close for deliberations pursuant to Iowa Code § 21.5(1)(f). A roll call vote was held and all members of the Commission present voted to go to closed session deliberations. Director Johnson excused herself from closed session due to her representation of the Commission in an earlier phase of the case.
At approximately 10:45 am, the Commission left closed session and each member stated his or her vote affirming and adopting the decision of the administrative law judge and agreed to sign the order as read into the record. See signed order for the written record of the vote.
IV. Commissioner Williams mentioned the well-attended ICRA 50th anniversary event on May 20, 2015.
IV. Next meeting tentatively set for September 18, 2015, at 1:00 pm at the Ames Human Rights
Commission. The meeting will include a training open to the public. Location to be determined.
